These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and ARTHAIQ, having its registered office at 190 Pragati Nagar, Indore, Madhya Pradesh – 452012 ("DailyVichar", "Company", "we", "our", or "us").

These Terms govern your access to and use of the DailyVichar platform, including our website, mobile applications, and related services (collectively, the "Platform").

By accessing, registering on, or using the Platform in any manner, you agree to be bound by these Terms and our associated policies, including the Privacy Policy, Copyright Policy, and Payment & Refund Policy. If you do not agree to these Terms, please do not use or access the Platform.

1. Account & Eligibility

• Legal Eligibility

To use the Platform, you must be legally eligible to form a binding contract under Indian law. By using the Platform, you represent and warrant that you meet this requirement.

• OTP-Based Login and Account Access

Access to the Platform may be authenticated through One-Time Password (OTP) based login using your mobile number or email ID. You are solely responsible for maintaining the confidentiality of your login credentials and ensuring that unauthorized persons do not access your account or device.

• Responsibility for Activity

You are responsible for all activity that occurs under your login session. DailyVichar will not be liable for any loss or damage resulting from unauthorized access unless directly attributable to our negligence.

• Multiple Accounts and Automated Access Prohibited

You shall not create multiple accounts or use automated means (bots, scripts, scraping tools) to access, interact with, or harvest data from the Platform.

2. Subscription, Payments & Mandates

• Subscription Services

Certain features of DailyVichar may be available only upon payment of subscription fees. These services are non-transferable, time-bound, and limited to the features outlined at the time of subscription.

• Payment Gateways

Payments may be processed through third-party gateways such as Razorpay, PhonePe, Paytm, or other providers. You agree to their respective terms and privacy policies. DailyVichar is not responsible for failures, delays, or service outages caused by these external providers.

• UPI AutoPay Mandates

If you enable UPI AutoPay, you authorize recurring payments through NPCI-compliant platforms. Such mandates are subject to RBI regulations. You may revoke any active mandate directly through your banking or UPI app. DailyVichar is not liable for delays or technical errors resulting from mandate revocation or setup failure.

• Taxes

All subscription fees are inclusive of applicable GST or other indirect taxes under Indian law, unless otherwise stated. Users shall not deduct or withhold any taxes from the amount payable to DailyVichar.

• Refunds and Disputes

Refunds shall be processed only in accordance with our Payment & Refund Policy. Any unauthorized chargebacks without prior escalation to support@dailyvichar.in may result in temporary or permanent suspension of your account.

3. Acceptable Use & Platform Conduct

You agree that you will NOT:

  • Upload content that infringes copyright, trademark, trade secret, publicity, or privacy rights;
  • Post defamatory, obscene, pornographic, or unlawful material;
  • Use the Platform to harass, threaten, impersonate, or abuse others;
  • Use DailyVichar in any manner that may disable, impair, or damage our systems;
  • Interfere with or disrupt other users’ experiences;
  • Use automated tools to scrape or extract data;
  • Exploit the Platform for phishing, malware distribution, or unauthorized advertising;
  • Violate applicable Indian laws, including the IT Act, 2000.

DailyVichar reserves the right to monitor user activity for compliance. Violations may lead to content removal, suspension, or legal reporting.

4. User Content and Ownership

• Rights to Your Content

You retain ownership of any content you create or upload (text, images, media). By submitting content, you grant DailyVichar a limited, non-exclusive, royalty-free license to store, display, and distribute such content as part of the Platform.

• Platform Content

If you use templates, designs, quotes, or AI-generated material provided by DailyVichar, the intellectual property remains owned by ARTHAIQ and may not be reused for resale or redistribution without permission.

• Representations

You represent that you have the legal right to upload and use the content and that it does not infringe any third-party rights.

• Removal and Review

DailyVichar may remove or disable content upon valid takedown requests or policy violations.

5. Community Guidelines

Users must:

  • Avoid hate speech or discriminatory content;
  • Not impersonate others;
  • Not incite violence or public disorder;
  • Respect privacy and consent of individuals shown in content;
  • Not upload morphed or AI-generated explicit content.

Violations may result in account suspension and reporting to authorities.

6. Content Moderation

DailyVichar may use:

  • AI and machine-learning filters,
  • Human moderation,
  • Support-based ticketing review system.

Upon valid regulatory or takedown request, infringing content will be removed within statutory timeframes under Indian IT Rules (typically 36–72 hours).

Repeat offenders may be permanently banned.

7. Data Retention & Deletion

• Retention

User data will be retained:

  • During active subscription;
  • Up to 90 days after account deletion;
  • Longer if required by Indian law.

• Deletion Requests

Users may request deletion by emailing support@dailyvichar.in. Requests will be processed within 15 working days, subject to legal obligations.

8. Intellectual Property

ARTHAIQ owns all rights to:

  • The DailyVichar brand,
  • Design templates,
  • Codebase,
  • Platform features,
  • AI tools (if applicable).

You may not:

  • Reverse engineer the Platform;
  • Use DailyVichar trademarks without permission;
  • Claim ownership over proprietary designs or systems.

9. Termination and Suspension

DailyVichar may suspend or terminate your access:

  • For violation of these Terms;
  • Upon judicial or regulatory request;
  • For payment disputes or fraud alerts;
  • For prolonged inactivity.

Users may request voluntary deactivation via email. Subscription benefits are forfeited upon account closure.

10. Limitation of Liability

DailyVichar shall not be liable for:

  • Indirect, incidental, or consequential damages;
  • Third-party service interruptions;
  • AI-generated output inaccuracies.

Total liability shall not exceed fees paid by you in the preceding 12 months.

All services are provided “as-is” without warranties.

11. Indemnification

You agree to indemnify and hold harmless ARTHAIQ, its directors, employees, and agents from any claims arising from:

  • Your use of the Platform;
  • Violation of these Terms;
  • Infringement of third-party rights.

12. Force Majeure

DailyVichar shall not be liable for delays due to events beyond reasonable control, including natural disasters, internet outages, governmental actions, or third-party service failures.

13. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Indore, Madhya Pradesh.

14. Changes to Terms

DailyVichar reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance.

15. Grievance Redressal

In accordance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:
